The rules for using NitroDial.

Acceptance and Eligibility

By accessing or using NitroDial, you agree to these Terms of Service. You must be at least 18 years old and able to form a binding contract to use the service.

Description of Services

NitroDial provides an AI-powered cold-calling platform that lets you create voice agents, run outbound campaigns, manage leads, and use related features. We may add, change, or discontinue features with reasonable notice where practical.

Account and Security

You are responsible for keeping your account credentials confidential and for all activity under your account. You must notify us promptly of unauthorized use, and we may suspend or terminate access if these Terms are breached.

Acceptable Use

You agree not to use NitroDial in ways that harm others, break the law, or interfere with the service.

• Violate any applicable law, regulation, or third-party rights.

• Send unsolicited communications, including spam or robocalls, where prohibited or without required consent.

• Harass, defame, threaten, or harm others, or promote illegal or harmful content.

• Attempt to gain unauthorized access to our systems, other accounts, or any network.

• Interfere with or disrupt the integrity or performance of the service.

• Resell or sublicense the service without our prior written consent unless explicitly permitted.

You are also responsible for obtaining any consents required for your calling activity, including telephony and marketing compliance obligations such as TCPA or GDPR where applicable.

Credits and Payment

Using NitroDial may require prepaid credits. Fees are shown at purchase time, are generally non-refundable except where required by law or agreed by us in writing, and may change with advance notice. Taxes are your responsibility unless we are required to collect them.

Your Data and Intellectual Property

You keep ownership of the content and data you upload or create. You give us a limited license to use, process, and store that data to operate and improve NitroDial. Our platform, software, branding, and materials remain our property or the property of our licensors.

Disclaimer of Warranties

NitroDial is provided on an as-is and as-available basis without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, error-free, or secure operation.

Limitation of Liability

To the fullest extent permitted by law, NitroDial and its affiliates, officers, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.

Indemnification

You agree to indemnify, defend, and hold harmless NitroDial and its affiliates and representatives from claims, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising from your use of the service, your data, or your breach of these Terms.

Changes to the Terms

We may update these Terms from time to time. When we do, we will post the revised Terms here, update the last-updated date, and may notify you by email or in-product notice for material changes. Continued use after the effective date means you accept the revised Terms.

General

These Terms, together with our Privacy Policy and any order or agreement that references them, form the entire agreement between you and NitroDial regarding the service. If any provision is unenforceable, the remaining provisions stay in effect. These Terms are governed by the laws of the jurisdiction in which NitroDial operates, without regard to conflict-of-law rules.
